California vs Employee Privacy
|
Background
The California Consumer Privacy Act is the country's most rigid consumer privacy act. It provides a package of rights to residents of California and customers of California companies concerning how their private data is collected, stored and used.
When the law was passed, there was an exemption for employees of those companies. This means that employee data did not need to be treated the same way as consumer data and could be processed and analyzed without being anonymized.
Last week, the California Legislature announced it would not extend that exemption past December 31, 2022.
